Terms of Service

Last Updated: August 2, 2026

Overview

This website is operated by STOREVIA LIMITED under the store name Hushvella.

Throughout this website, the terms “Hushvella,” “we,” “us,” and “our” refer to STOREVIA LIMITED, as applicable.

Hushvella provides this website, including the information, products, features, content, customer support, and other services available through it, subject to your acceptance of these Terms of Service and all policies and notices referenced in them.

These Terms of Service apply to all visitors and users of the website, including browsers, customers, purchasers, account holders, vendors, suppliers, and persons who submit content.

By accessing this website, placing an order, creating an account, submitting content, or otherwise using our services, you agree to be bound by these Terms of Service.

These Terms incorporate by reference our:

  • Privacy Policy

  • Shipping and Delivery Policy

  • Return and Refund Policy

  • Any product-specific terms displayed before purchase

  • Any other policies expressly incorporated into these Terms

Please read these Terms carefully before using the website.

If you do not agree to these Terms, you must not use the website or place an order.

Section 1 – Eligibility and Online Store Terms

You must be at least the age of majority in your state, province, territory, or country of residence to place an order or create an account.

If you permit a minor dependent to access the website, you are responsible for supervising that use to the extent permitted by applicable law.

You may not use our website or products:

  • For an unlawful or unauthorized purpose

  • In violation of any applicable law or regulation

  • To infringe another person’s rights

  • To engage in fraud, deception, abuse, or harmful conduct

  • In a manner inconsistent with product instructions or warnings

You are responsible for determining whether your purchase, possession, importation, and use of a product are lawful in your location.

A violation of these Terms may result in suspension or termination of access, cancellation of an order, refusal of service, or other lawful action.

Section 2 – General Conditions

We reserve the right to refuse, restrict, suspend, or terminate service when reasonably necessary, including in response to:

  • Suspected fraud or unauthorized payment

  • Abusive, threatening, or unlawful conduct

  • Repeated policy violations

  • Return or refund abuse

  • Product or shipping restrictions

  • Security concerns

  • Technical or operational limitations

  • A legal or regulatory requirement

We will not refuse service for a reason prohibited by applicable law.

You may not reproduce, duplicate, copy, sell, resell, exploit, or commercially use any part of the website or service without our prior written authorization, except where applicable law expressly permits such use.

Section headings are provided for convenience and do not limit or otherwise affect these Terms.

Section 3 – Account Information and Security

Certain website features may allow or require you to create an account.

You agree to provide information that is current, complete, and accurate.

You are responsible for:

  • Maintaining the confidentiality of your account credentials

  • Restricting access to your account and devices

  • Activities performed through your account

  • Promptly notifying us of suspected unauthorized access

You must not impersonate another person, create an account using false information, or use an account without authorization.

We may suspend or terminate an account that we reasonably believe is fraudulent, compromised, abusive, unlawful, or in violation of these Terms.

Hushvella is not responsible for loss resulting from your failure to protect your account credentials, except to the extent that responsibility cannot legally be excluded.

Section 4 – Orders and Contract Formation

Submitting an order constitutes an offer to purchase the products identified in the order.

An order confirmation acknowledges receipt of your order but does not necessarily constitute final acceptance of the order.

We may review an order before accepting or fulfilling it.

An order is generally accepted when we:

  • Confirm that the order has entered fulfillment;

  • Dispatch the product; or

  • Otherwise expressly confirm acceptance in writing.

We may refuse, limit, or cancel an order before shipment for a reasonable lawful reason, including:

  • Product unavailability

  • Pricing or description errors

  • Payment authorization failure

  • Suspected fraud or unauthorized activity

  • Shipping restrictions

  • Address problems

  • Quantity limitations

  • Technical errors

  • Supplier or fulfillment limitations

  • Legal or regulatory restrictions

If we cancel a paid order or product before shipment, we will issue the required refund to the original payment method.

We may limit quantities purchased per person, household, account, payment method, address, or order when reasonably necessary.

Products are intended primarily for personal and household use unless we expressly agree otherwise.

Section 5 – Order Changes and Cancellations

Contact us as soon as possible if you need to change or cancel an order.

Requests received within 12 hours after purchase will be reviewed, but cancellation or modification is not guaranteed.

Orders may enter processing or fulfillment shortly after submission.

We may be unable to cancel or change an order after:

  • Processing has begun

  • A shipping label has been created

  • Packaging has begun

  • The order has been transferred to a fulfillment provider

  • The order has been given to a carrier

An order is not considered canceled or modified until Hushvella provides written confirmation.

If cancellation is no longer possible, you may request a return after delivery in accordance with our Return and Refund Policy.

Nothing in this section limits a cancellation or refund right that applicable law requires us to provide.

Section 6 – Products and Services

Certain products may be available exclusively through our online store.

Products may have limited quantities and may be discontinued without notice.

We may:

  • Add or remove products

  • Limit sales by person, location, jurisdiction, or quantity

  • Modify product assortments

  • Discontinue products

  • Change packaging or non-material product details

  • Correct inaccurate product information

Any sales restriction will be applied in a lawful and non-discriminatory manner.

Products are subject to our Return and Refund Policy.

Availability displayed on the website is not guaranteed until the applicable order has been accepted and fulfilled.

Section 7 – Product Information and Images

We make reasonable efforts to present product descriptions, dimensions, materials, specifications, compatibility information, photographs, and other details accurately.

Product information may be supplied by manufacturers, distributors, fulfillment providers, or other third parties.

Actual products may have reasonable differences in:

  • Color

  • Texture

  • Pattern placement

  • Finish

  • Stitching

  • Packaging

  • Dimensions within manufacturing tolerances

  • Non-material design details

The appearance of colors and images may vary based on screen settings, device type, lighting, photography, and manufacturing variation.

We cannot guarantee that a screen will display every color or detail with complete accuracy.

Customers must review the entire product page, available measurements, materials, warnings, compatibility information, and care instructions before purchasing.

A minor difference that does not materially affect the identity, function, or advertised characteristics of a product is not automatically a defect.

Nothing in this section permits us to provide a product that is materially different from what was ordered.

Section 8 – Sleep, Relaxation, and Wellness Products

Hushvella offers general consumer products related to sleep environments, bedroom comfort, relaxation, and lifestyle use.

Unless expressly and lawfully identified otherwise on the applicable product page, Hushvella products are not represented as:

  • Medical devices

  • Diagnostic products

  • Treatments for sleep disorders

  • Treatments for breathing disorders

  • Treatments for pain or mental health conditions

  • Products that cure, prevent, or treat disease

Product descriptions and website content are provided for general informational and commercial purposes.

They do not constitute medical advice, diagnosis, treatment, or a substitute for professional healthcare.

Individual comfort, sleep quality, temperature preference, sensitivity, and product experience vary.

Customer reviews and testimonials describe individual experiences and do not guarantee that another customer will obtain the same result.

Consult a qualified healthcare professional before using a product if you:

  • Have a diagnosed sleep or breathing condition

  • Have persistent sleep difficulties

  • Have allergies or material sensitivities

  • Are pregnant

  • Have a circulation, mobility, pain, or other medical condition

  • Have concerns about whether a product is appropriate for you

Stop using a product and seek appropriate professional assistance if you experience breathing difficulty, an allergic reaction, injury, significant irritation, or another unexpected health concern.

No disclaimer on this website authorizes false, misleading, or unsubstantiated health claims.

Section 9 – Product Use and Safety

You are responsible for reading and following all product instructions, warnings, labels, cleaning directions, age restrictions, assembly directions, and safety information.

Products must be used only for their intended lawful purposes.

You must not:

  • Modify a product in a way that creates an unreasonable risk

  • Use a product contrary to warnings or instructions

  • Allow children or vulnerable persons to use a product without appropriate supervision

  • Place products near heat, flame, water, electricity, or other hazards contrary to instructions

  • Use products that appear damaged or unsafe

Immediately stop using a product that appears damaged, defective, excessively hot, unstable, contaminated, or otherwise unsafe.

Nothing in these Terms limits liability that cannot legally be excluded for a defective or unsafe product.

Section 10 – Prices and Currency

Product prices may change without advance notice.

The price applicable to an order is generally the price displayed during checkout when the order is submitted, subject to correction of an obvious error.

Unless otherwise stated, prices are displayed in U.S. dollars.

Currency conversion performed by a bank, card issuer, payment provider, browser, application, or other third party may differ from the amount displayed by Hushvella.

You are responsible for any lawful foreign transaction, currency conversion, or payment-provider fees charged independently by your financial institution.

We may modify or discontinue products, services, promotions, or website features without notice, subject to obligations relating to accepted orders and applicable law.

Section 11 – Taxes, Duties, and Other Charges

Applicable sales tax or similar transaction tax may be calculated during checkout based on the information available to us.

For international orders, customs duties, import taxes, brokerage charges, handling charges, and other governmental or carrier charges may not be included unless expressly stated during checkout.

The recipient is responsible for applicable destination-country charges unless checkout expressly states otherwise.

We do not control the assessment or amount of third-party customs, tax, brokerage, or carrier charges.

All mandatory charges collected by Hushvella will be disclosed as required by applicable law.

Section 12 – Shipping and Delivery

Order processing, shipping fees, delivery estimates, tracking, address changes, split shipments, international shipping, lost packages, and delivery issues are governed by our Shipping and Delivery Policy.

Delivery and transit estimates are not guaranteed unless expressly confirmed as guaranteed.

We must have a reasonable basis for shipment representations.

If we cannot ship an order within an applicable promised or legally required period, we may provide a delay notice, request consent to a revised shipment date, offer cancellation, or issue a refund as required by applicable law.

Where a customer does not consent to a delay when consent is legally required, the affected unshipped order will be canceled and refunded as required.

Section 13 – Returns and Refunds

Returns, refunds, exchanges, damaged products, incorrect products, non-returnable products, return shipping costs, and refund processing are governed by our Return and Refund Policy.

Submitting a return or refund request does not automatically mean that it has been approved.

Products must not be returned without written authorization and specific return instructions.

The legal and administrative address of STOREVIA LIMITED is not a return address unless Hushvella expressly authorizes a return to that address in writing.

Nothing in our policies limits a refund, return, replacement, warranty, or consumer remedy that cannot legally be excluded.

Section 14 – Billing and Payment Information

You agree to provide current, complete, and accurate billing, payment, contact, and shipping information.

You represent that:

  • You are authorized to use the selected payment method.

  • Information supplied during checkout is accurate.

  • Charges associated with the order may be submitted to the selected payment method.

  • You will promptly update information necessary to complete the transaction.

Payments may be processed by third-party payment providers.

We do not necessarily receive or store complete payment card information.

Payment authorization does not guarantee acceptance or fulfillment of an order.

We may cancel, delay, or request verification for an order when we reasonably suspect:

  • Unauthorized payment

  • Fraud

  • Identity theft

  • Payment reversal risk

  • Inconsistent billing information

  • Unlawful activity

Do not send complete payment card numbers, passwords, or sensitive authentication information through ordinary customer support email.

Section 15 – Pricing and Listing Errors

The website may occasionally contain typographical errors, inaccuracies, omissions, outdated information, or technical errors concerning:

  • Product descriptions

  • Prices

  • Discounts

  • Promotions

  • Availability

  • Shipping charges

  • Delivery estimates

  • Specifications

  • Images

We may correct an error and update information at any time.

If an obvious pricing or listing error affects an order that has not been shipped, we may:

  • Contact you for instructions

  • Offer the product at the corrected price

  • Cancel the affected product

  • Issue an appropriate refund

We will not charge a higher corrected price without obtaining any consent required by law.

We will not rely on this section to engage in deceptive pricing or avoid a valid accepted sale where applicable law prohibits doing so.

Section 16 – Promotions, Coupons, and Discounts

Promotions, coupons, discount codes, gifts, and special offers may be subject to additional terms displayed with the offer.

Unless otherwise stated:

  • Offers cannot be exchanged for cash.

  • Offers cannot be applied retroactively.

  • Only one code may be used per order.

  • Offers may exclude selected products.

  • Offers may have expiration dates or quantity limits.

  • Offers may be limited to one customer, household, account, or address.

  • Offers are void where prohibited.

  • Unauthorized reproduction, resale, or transfer is prohibited.

We may cancel or refuse a promotion obtained through fraud, technical manipulation, unauthorized distribution, or violation of its stated terms.

A promotion will not be modified retroactively in a manner that unlawfully deprives a customer of a completed purchase.

Section 17 – Optional Third-Party Tools and Services

The website may provide access to third-party tools, applications, payment services, tracking services, social media services, or integrations.

We may not monitor or control every third-party tool.

Third-party services may be governed by their own terms and privacy policies.

Your use of an optional third-party service is at your discretion and subject to the third party’s applicable terms.

To the fullest extent permitted by law, Hushvella is not responsible for independent acts, omissions, outages, content, or policies of third-party services that we do not control.

This section does not limit any responsibility Hushvella has as the seller or as otherwise required by law.

Section 18 – Third-Party Links

The website may contain links to websites or resources operated by third parties.

A link does not necessarily mean that Hushvella endorses, controls, guarantees, or assumes responsibility for the third party.

We are not responsible for independently operated third-party content, privacy practices, products, or services, except where applicable law provides otherwise.

Review the third party’s policies before submitting information or completing a transaction.

Complaints concerning a third-party product or service should generally be directed to the applicable third party, without limiting any rights you may have against Hushvella.

Section 19 – Reviews, Testimonials, and Customer Content

The website may allow customers to submit reviews, ratings, photographs, videos, comments, feedback, questions, or other content.

You retain ownership of content you lawfully create.

By submitting content to Hushvella, you grant us a non-exclusive, worldwide, royalty-free, transferable, sublicensable license to host, store, reproduce, format, translate, publish, display, distribute, and use that content for operating, improving, and promoting Hushvella, subject to applicable law and our Privacy Policy.

This license continues for as long as the content is used in connection with Hushvella, unless applicable law requires otherwise.

You represent that submitted content:

  • Is based on a genuine experience when presented as a review

  • Is accurate to the best of your knowledge

  • Does not impersonate another person

  • Does not infringe intellectual property, privacy, publicity, or other rights

  • Does not contain unlawful threats, harassment, hate speech, malware, or confidential information

  • Does not contain deceptive or fraudulent claims

  • Discloses any material relationship, free product, discount, payment, employment, or other incentive where disclosure is required

We do not require customer reviews to be positive.

We will not prohibit or penalize a truthful review merely because it is critical or negative.

Any incentive offered for a review must not be conditioned, expressly or implicitly, on the review expressing a positive or negative sentiment.

We may moderate, label, decline, or remove content that:

  • Is fake or deceptive

  • Is unrelated to the product or transaction

  • Contains unlawful, abusive, obscene, or threatening material

  • Discloses sensitive personal information

  • Infringes another person’s rights

  • Contains spam or malicious links

  • Violates these Terms

  • Must be removed by law

We may correct formatting or remove personal information, but we will not materially alter the meaning of a review in a misleading manner.

We do not guarantee that every submitted review will be published or remain published.

Section 20 – Feedback and Suggestions

If you voluntarily provide ideas, proposals, suggestions, designs, concepts, or other feedback, you agree that we may use that feedback without restriction or compensation, unless we separately agree otherwise in writing.

You must not submit confidential business information or another party’s proprietary material as feedback without authorization.

This section does not transfer ownership of unrelated content or intellectual property that you do not intend to submit as feedback.

Section 21 – Intellectual Property

The website and its original content, including trademarks, logos, text, graphics, designs, layouts, software, and compilations, are owned by or licensed to Hushvella and are protected by applicable intellectual property laws.

“Hushvella” and associated branding may not be used in a manner that falsely suggests sponsorship, endorsement, affiliation, or authorization.

You may access and use the website for personal, lawful, non-commercial shopping purposes.

Without prior written permission, you may not:

  • Copy or republish substantial website content

  • Use our branding to impersonate Hushvella

  • Scrape or extract information through unauthorized automated means

  • Reverse engineer website software where prohibited

  • Remove copyright, trademark, or proprietary notices

  • Create deceptive websites, advertisements, or accounts using our identity

  • Sell or license our protected content

Rights not expressly granted are reserved.

Section 22 – Intellectual Property Complaints

If you believe content on the website infringes your copyright, trademark, or other intellectual property right, contact us at anjrajorly@gmail.com.

Include:

  • Your name and contact information

  • Identification of the protected work or right

  • Identification and location of the allegedly infringing material

  • A description of your ownership or authority

  • A good-faith statement explaining the complaint

  • Supporting documentation

  • Your physical or electronic signature where appropriate

We may request additional information and may remove or restrict content while reviewing a complaint.

Submitting a false or misleading infringement complaint may result in legal liability.

Nothing in this section represents that Hushvella has appointed a statutory copyright agent unless such an appointment is separately and properly registered.

Section 23 – Prohibited Uses

You may not use the website or service to:

  • Violate applicable law

  • Solicit or participate in unlawful conduct

  • Infringe intellectual property or privacy rights

  • Harass, abuse, threaten, defame, or discriminate unlawfully

  • Submit false or misleading information

  • Transmit malware, viruses, or harmful code

  • Collect personal information unlawfully

  • Send spam or unauthorized commercial messages

  • Circumvent security or access controls

  • Interfere with website operation

  • Conduct unauthorized scraping or automated extraction

  • Manipulate prices, promotions, reviews, or checkout systems

  • Submit fraudulent orders, returns, refunds, or payment disputes

  • Impersonate Hushvella or another person

  • Use the service in a way that could harm customers, Hushvella, or third parties

We may investigate and take lawful action concerning suspected prohibited conduct.

Section 24 – Privacy and Personal Information

Our collection, use, disclosure, storage, and protection of personal information are governed by our Privacy Policy.

By using the website, you acknowledge that information may be processed by service providers necessary to operate the store, process payments, prevent fraud, fulfill orders, provide customer support, and comply with legal obligations.

These Terms do not replace the notices, rights, and choices described in our Privacy Policy.

Section 25 – Electronic Communications

By using the website or contacting us electronically, you consent to receive transactional communications in electronic form, including:

  • Order confirmations

  • Shipping notices

  • Customer support responses

  • Policy notices

  • Refund communications

  • Security notices

Electronic communications satisfy any requirement that communications be in writing to the extent permitted by applicable law.

Marketing communications are subject to applicable consent and unsubscribe requirements.

You are responsible for maintaining a valid email address and checking relevant folders for order-related communications.

Section 26 – Accuracy, Completeness, and Timeliness of Information

We make reasonable efforts to maintain accurate and current information.

However, general website content may occasionally become incomplete, outdated, or inaccurate.

General informational content should not be used as the sole basis for medical, legal, financial, safety, or other professional decisions.

Product-specific representations made as part of a sale remain subject to applicable law.

Historical information may be provided for reference and may not reflect current conditions.

We may update website content but do not undertake an unlimited obligation to update every item immediately.

Section 27 – Modifications to the Website and Service

We may modify, suspend, restrict, or discontinue website features or services.

We are not required to maintain every feature indefinitely.

Any modification will remain subject to:

  • Obligations concerning existing accepted orders

  • Required refunds

  • Applicable warranties

  • Applicable consumer protection laws

  • Other rights that cannot legally be excluded

We are not liable solely because a non-essential website feature is modified or discontinued, except where applicable law provides otherwise.

Section 28 – Manufacturer and Supplier Information

Some products may be manufactured, distributed, stored, or fulfilled by third parties.

References to a manufacturer or supplier do not make that party a contracting party to your purchase unless expressly stated.

Hushvella remains responsible for its obligations as the seller to the extent required by applicable law.

Manufacturer instructions, warnings, and warranties may apply in addition to these Terms.

Customers should not contact or return products to a manufacturer, supplier, or fulfillment facility unless instructed to do so.

Section 29 – Warranties and Disclaimers

Nothing in these Terms excludes or limits a warranty, guarantee, condition, remedy, or consumer right that cannot legally be excluded or limited.

Except for any express written warranty provided before purchase and to the fullest extent permitted by law, the website and general website services are provided on an “as available” basis.

We do not warrant that:

  • The website will operate continuously without interruption.

  • Every technical error will be corrected immediately.

  • The website will be compatible with every device or browser.

  • General informational content will meet every individual purpose.

  • A product will produce a particular subjective comfort or sleep result.

Any product warranty expressly offered by Hushvella or a manufacturer will be governed by its own written terms.

Where federal or state law prohibits the disclaimer or limitation of implied warranties because an express written warranty has been provided, the prohibited disclaimer or limitation will not apply.

Some jurisdictions do not permit certain warranty exclusions or limitations. In those jurisdictions, the applicable exclusions apply only to the maximum extent legally permitted.

Section 30 – Limitation of Liability

Nothing in these Terms excludes or limits liability for:

  • Fraud or fraudulent misrepresentation

  • Willful misconduct

  • Gross negligence where it cannot legally be limited

  • Death or personal injury where limitation is prohibited

  • A defective product where liability cannot legally be excluded

  • Violation of a non-waivable consumer right

  • Any other liability that applicable law does not permit us to exclude

Subject to the paragraph above and to the fullest extent permitted by law, Hushvella and STOREVIA LIMITED will not be liable for indirect, incidental, special, consequential, exemplary, or punitive losses arising from use of the website or products where such losses were not reasonably foreseeable or where exclusion is legally permitted.

Examples may include loss of data, profit, revenue, goodwill, or business opportunity.

To the fullest extent permitted by law, any aggregate monetary liability arising from an individual order will not exceed the amount paid for the product giving rise to the claim.

The preceding monetary limit does not apply where applicable law prohibits it.

Some states and jurisdictions do not allow exclusions or limitations of certain damages. In those locations, these limitations apply only to the maximum extent permitted.

Section 31 – Customer Responsibility and Indemnification

To the extent permitted by law, you agree to be responsible for losses, claims, or reasonable expenses caused by your unlawful use of the website, violation of these Terms, infringement of another person’s rights, or fraudulent conduct.

You will not be required to indemnify Hushvella for loss caused by Hushvella’s own unlawful conduct, negligence, breach, defective products, or violation of non-waivable legal duties.

We reserve the right to control the defense of a covered third-party claim, while acting reasonably and providing appropriate notice.

This section does not apply to the extent prohibited by consumer protection law.

Section 32 – Events Outside Reasonable Control

Neither party will be responsible for a delay or failure caused solely by an event outside that party’s reasonable control, including:

  • Natural disaster

  • Severe weather

  • War or civil unrest

  • Government action

  • Public-health emergency

  • Transportation interruption

  • Carrier disruption

  • Labor dispute

  • Widespread utility failure

  • Cyberattack

  • Infrastructure failure

The affected party must take reasonable steps to minimize the effect of the event.

This section does not eliminate obligations relating to refunds, consumer rights, or other duties that cannot legally be excluded.

Section 33 – Termination

These Terms remain effective unless terminated by you or Hushvella.

You may stop using the website at any time.

We may suspend or terminate access if you materially violate these Terms or if suspension is reasonably necessary for security, fraud prevention, legal compliance, or protection of users.

Termination does not affect:

  • Rights and obligations arising before termination

  • Payment obligations

  • Accepted orders

  • Refund or return rights

  • Intellectual property provisions

  • Liability provisions

  • Dispute provisions

  • Other provisions intended to survive

Section 34 – Severability

If a provision of these Terms is held invalid, unlawful, or unenforceable, it will be limited or removed only to the minimum extent necessary.

The remaining provisions will continue in effect where legally possible.

A court or competent authority may interpret an invalid provision in a manner that most closely reflects its lawful purpose.

Section 35 – No Waiver

A failure or delay by Hushvella to enforce a provision does not waive that provision or the right to enforce it later.

A waiver is effective only if made in writing by an authorized representative.

A waiver concerning one matter does not constitute a waiver concerning another matter.

Section 36 – Entire Agreement

These Terms and the policies incorporated into them constitute the agreement between you and Hushvella concerning use of the website and purchases through the website.

They supersede prior communications concerning the same subject, except for:

  • An accepted order

  • A product-specific written warranty

  • A written agreement signed by an authorized representative

  • Rights that cannot legally be waived

Ambiguity will not automatically be interpreted against a party solely because that party drafted the Terms.

Section 37 – Assignment

You may not transfer your contractual rights or obligations under these Terms without our prior written consent, except where applicable law provides otherwise.

We may transfer our rights or obligations as part of a merger, restructuring, financing, asset transfer, sale of business, or transfer to an affiliated entity, provided that the transfer does not unlawfully reduce your consumer rights.

Section 38 – Governing Law and Jurisdiction

These Terms and transactions with Hushvella are generally governed by the laws of Hong Kong, without regard to conflict-of-law principles.

However, this choice of law does not deprive a consumer of mandatory protections that apply under the laws of the consumer’s state, country, or place of residence and that cannot legally be waived by contract.

The courts of Hong Kong will have non-exclusive jurisdiction over disputes relating to these Terms.

Nothing in this section prevents a consumer from bringing a claim in another competent court, small claims forum, or regulatory process where applicable law grants a non-waivable right to do so.

Nothing in these Terms requires private arbitration or waives participation in a class proceeding unless the parties later enter into a separate legally valid written agreement.

Before commencing formal proceedings, the parties are encouraged, but not required where prohibited or impractical, to contact one another and attempt to resolve the issue in good faith.

Section 39 – Changes to These Terms

We may update these Terms to reflect changes in:

  • Law or regulation

  • Products or services

  • Technology

  • Payment or fulfillment operations

  • Security practices

  • Business operations

The revised Terms will be posted with an updated revision date.

Changes will generally apply prospectively.

The version in effect when an order was placed will generally govern that order, unless:

  • A change is required by law;

  • The new version is more favorable to the customer; or

  • The parties lawfully agree otherwise.

Continued use of the website after an effective update constitutes acceptance of the updated Terms for future use, to the extent permitted by law.
